Consumer Code for Home Builders

As a result of the Barker Review of 2004 and the Office of Fair Trading (OFT) Market Study into the house building industry dated October 2008, a group of stakeholders within the industry joined forces to develop a voluntary Code of Conduct for Home Builders to address the issues raised relating to customer service and satisfaction.

For these reasons, the major industry trade bodies and the Council of Mortgage Lenders have joined with warranty providers to introduce the Consumer Code for Home Builders. The Consumer Code applies to Home Buyers who, on or after 1st April 2010, reserve to buy a new or newly converted home built by a Home Builder / Developer under the insurance protection of one of the supporting Home Warranty Bodies. Currently there are three supporting Home Warranty providers including LABC Warranty.

Consumer Code for Home Builders: Background

The Consumer Code sets requirements that Home Builders who are registered with the supporting Home Warranty Bodies such as LABC Warranty must meet.

Developers and Home Builders may adopt the standards of good practice, procedures and information, as detailed in the Code guidance against each core requirement.

The purpose of the Code is to ensure that Home Buyers:

  • are treated fairly;
  • know what service levels to expect;
  • are given reliable information upon which to make their decisions; and
  • know how to access speedy, low-cost dispute-resolution arrangements if they are dissatisfied.


The Home Warranty Bodies have agreed to require all their registered builders to adopt and comply with the Code as a condition of the builder's registration with them. Where a Home Builder is found to be in serious breach of the Code, Home Warranty Bodies can apply a range of sanctions, which could ultimately include removal from the relevant Home Warranty Body's register and exclusion from all registers run by other Home Warranty Bodies who participate in the Code scheme.

Consumer Code for Home Builders: E-learning

An e-learning course is now available free for registered builders or for companies who are affiliated to registered builders such as estate agents, solicitors etc. Staff from such affiliated companies will need the name of the registered builder that they are affiliated to when registering for the course.

The course is designed for customer facing staff needing to have an understanding of the Consumer Code. After self-registration and approval it takes about 30 minutes to complete and learners can print a certificate at the end if they have passed the test.
